I'm no lawyer but I think they have to file a judgement on you to collect?

she said they would auction it off and garnish the rest, we fell on hard times and still there unfortunetly, this is all we need now, **** the luck....thanks for your time, catfishingharry

NOT allowed in Texas. Texas only allows garnishment for child support. Regular debts are not permitted to garnish wages.

Next time this person calls you and mentions garnishment, tell her/him that Texas law does not permit that. If they persist, report them as that is an illegal debt collection tactic (call Texas Attorney General office in Austin).

they can only garnish your wages if they sue you and the judge agrees to garnishment. heres the web site, only taxes and child support can be taken immedietly. http://bcsalliance.com/index.html it really bites when you get in a bind, even temporarily!!! thanks to everyone on your responses, catfishingharry, NOW I'M READY TO FISH!!!!

Harry they cannot garnish your wages in the state of Texas. They violated Fed law when she told you that. But to collect on it you would have to have it recorded. You have to prove they said it. Otherwise it is your word against theres. If they take you to court all they can do is get a judgement against you. The judgement is not worth the paper it is wrote on. I have about a dozen of them on people that I filed on that are worthless.

Everyone is correct that they cannot garnish your wages to collect a debt and it was a violation of federal and state law to claim they could or would. Keep in mind though that they can execute on a judgment if and when they get one. The easiest thing to execute on in Texas is cash, meaning your bank account. Most other things are exempt unless you have a lot of assets--boats, real property that is not your homestead, etc.. Judgments also hang around for a while. They are good for 10 years and can be extended. Send me a PM if you have any questions. MED
